Public Procurement Regulations
In common with all Government departments and many other public sector organisations, the Agency is subject to a series of EC procurement directives, implemented in the UK by the Public Procurement Regulations, which regulate how the Agency purchases works, goods and services. The Agency is also bound by the World Trade Organisation Government Procurement Agreement. These rules promote non-discriminatory and transparent competition between suppliers of goods, services, works and utilities.
Under the EC Procurement Directives if the value of a contract proposal is expected to exceed the threshold, and it is not exempted by the Regulations, the Agency has to publish a Contract Notice in the Supplement to the Official Journal of the European Communities (OJEC). On the 1 January 2004 the thresholds were set at £3,834,411, excluding VAT, for all works contracts. (Under Regulation 23 of the Public Works Contracts Regulations 1991, subsidised works contracts have a threshold of £3,236,542, excluding VAT). For supplies the threshold is currently £99,695, excluding VAT. Not all types of services have to be advertised in the OJEC but where they do, the threshold is £100,410, excluding VAT. The types of service in this category include engineering services and integrated engineering services, technical testing and analysis services. (Under Regulation 25 of the Public Services Contracts Regulations 1993, subsidised services contracts have a threshold of £123,740 excluding VAT). The Public Services Contracts Regulations 1993 Schedule 1 lists the categories of services which have to be advertised (Part A) and those which do not (Part B).

If you wish to be invited to tender for contracts appearing in the Supplement you will need to respond to the relevant advertisement. The Regulations set out minimum times which suppliers are allowed to reply to Notices in the OJEC. If you reply within the time limit specified in a notice published under the Restricted procedure, and enclose with your reply all the details requested, then we will consider whether to invite you to tender.
Your application will not be considered unless you submit all the information specified in the OJEC and within the specified time - even if you had previously expressed an interest.
There are other procedures set by the Regulations - "Open" and "Negotiated" - but the Agency does not use them very often, though the latter is used for Design Build Finance Operate contracts.
For smaller value contracts, not advertised in the Supplement, but listed on the contracts pages you should get in touch with the relevant Project Sponsor who will liase with the appropriate Procurement Team to ensure your interest is noted and considered at Preliminary Enquiry/Tender Invitation Selection stage.
