LAND COMPENSATION ACT 1973 (AS AMENDED)

A417 Birdlip Hill climbing lane

The Secretary of State for the Environment Transport and the Regions hereby gives notice that the improvement on the A417 Birdlip Hill Climbing Lane was first open to public traffic on 24 April 2001.

Under the above legislation there is a right to compensation for depreciation of more than £50 in the value of certain interests in land due to specified physical factors which arise from the use of a new or altered highway and resulting from specified physical factors (noise, vibration, smell, fumes, smoke, and the discharge on to the land in respect of which the claim is made of any solid or liquid substance). Compensation is assessed by reference to prices current at a date twelve months after the highway is first open to public traffic or, in the case of an altered highway, first open to public traffic after completion of the alterations.

Section 2 of the Land Compensation Act 1973 specifies qualifying interests for compensation, and there are special provisions for claims by mortgagees and persons entitled under trusts or settlements. However, no compensation can be paid under Part 1 where property has been acquired for the purpose of constructing the highway.

Any person entitled to a qualifying interest who considers he has a claim under the said provisions may obtain further information and claim form from Bal Sumal, Operational Directorate Lands Branch of the Highways Agency at the address below quoting reference HA65/12/15/32718.

5 Claims may be made on or after 24 April 2002 (the "first claim date". Claims should be made within six years from this date. However, if an interest is disposed of or (insofar as the interest is in the land which is not dwelling) a tenancy is granted, the claim must be made before such a disposal or the tenancy granted.

Schedule

The scheme comprises the widening of the Air Balloon Roundabout circulatory carriageway to two lanes on the A417 axis towards Swindon, commencing the climbing lane on Birdlip Hill from Air Balloon Public house and maintaining the existing one metre strip on Birdlip Hill from the Air Balloon Roundabout exit. The scheme also provides dedicated right hand turn lanes into the Air Balloon Public House and Crickley Ridge private residence.
