M25 junction 25 westbound improvements [2]

The Secretary of State for Environment, Transport and the Regions hereby gives notice that the public works detailed in the schedule below were first used after completion on 31 March 2002.

Under Part 1 of the Land Compensation Act 1973 as amended there is a right to compensation in respect of any depreciation of more than £50 in the value of certain interests in land caused by the use of public works and resulting from specified physical factors. In the case of street lighting the applicable physical factor is artificial lighting. Compensation is assessed by reference to prices current at a date twelve months after the works are first used after completion.

Interests qualifying for compensation are specified in section 2 of the above-mentioned Act and there are special provisions relating to claims by mortgagees and persons entitled under trusts or settlements. However, no compensation can be paid under Part 1 where part of a property for the purpose of installing the works.

Claims may be made twelve months after the public works are first used after completion, that is on or after 31 March 2003 (the "first claim day"). Claims should be made within six years from this date. However, any person who within the twelve months preceding that date makes a contract for disposing of his interest or (insofar as the interest is in land which is not a dwelling) for granting a tenancy may make a claim within that period and must do so before the interest is disposed of or tenancy granted. Compensation in such cases will not be payable before the first claim day.

Schedule

Provision of a new third lane on junction 25 of the M25 at Waltham Cross, which runs 0.6 mile (1km) on the westbound carriageway. Three direction signs on the overhead gantries east of Junction 25 have been improved and lighting and fencing have been placed for improving safety at the emergency crossovers at either end of the tunnel.
