The M25 Motorway (Heathrow Terminal 5 Access) Compulsory Purchase Order (OD No 27) 2002

The Secretary of State for Transport, Local Government and the Regions in exercise of his powers under sections 239, 240, 246 and 260 of the Highways Act 1980, as extended and supplemented by section 250 of that Act and under section 2 of the Acquisition of Land Act 1981, and of all other powers enabling him in that behalf, hereby makes the following Order:-

  1. The Secretary of State is hereby authorised to purchase compulsorily the land described in the schedule to this Order and delineated and coloured pink on the plan and the rights described in the said schedule over the land described in it, and delineated and coloured blue on the plan.
  2. The land and rights referred to in paragraph (1) of this article are authorised to be purchased compulsorily for the following purposes:-
    1. the construction of the special roads near Longford in the London Borough of Hillingdon; at Staines, in the Borough of Spelthorne, in the County of Surrey; and, in the Parish of Colnbrook with Poyle, in the Borough of Slough in pursuance of the M25 Motorway (Heathrow Terminal 5 Access) (No.1) Connecting Roads Scheme 2002 ;
    2. the construction of highways and the provision of new means of access to premises near Longford, in the said Borough; at Staines, in the said Borough, and County; and, in the Parish of Colnbrook with Poyle, in the said Borough and County in pursuance of the M25 Motorway (Heathrow Terminal 5 Access) (No. 1) Side Roads Order 2002;
    3. the improvement of the M25 Motorway near Longford in the London Borough of Hillingdon;
    4. the diversion of watercourses and the execution of other works on watercourses in connection with the construction of special roads, the construction and improvement of other highways and the execution of other works mentioned above;
    5. use by the Secretary of State in connection with such construction and improvement of highways and the execution of other works mentioned above; and
    6. the mitigation of adverse effects which the existence or use of the special roads and certain of the highways which the Secretary of State proposes to construct or improve will have on their surroundings.
    7. Copies of the said Scheme and Order, each with its accompanying plans, are deposited, along with the plan referred to in article 4 below.

In relation to the purchase authorised by this Order, Parts II and III of Schedule 2 to the Acquisition of Land Act 1981 are hereby incorporated with this Order, subject to the modifications that references in those Parts to the undertaking shall be construed as references to the land authorised to be purchased or, as the case may be, to the land over which rights are authorised to be purchased, and to any buildings or works construed or to be constructed on it.

For the purpose of the provisions of Schedule 2 to the Acquisition of Land Act 1981, as incorporated with this Order, the prescribed distance in relation to any seam of minerals lying under land adjoining the works to be constructed upon the land described in the schedule to this Order shall be such a lateral distance from those works on every side of them as is equal at every point along those works to one half of the depth of the seam below the natural surface of the ground at the point or forty yards whichever is the greater.

In this Order:-

"the plan"

means the plan folio consisting of a key plan and 4 sheets bound together, respectively numbered 1 to 4, marked "The M25 Motorway (Heathrow Terminal 5 Access) Compulsory Purchase Order (OD No 27) 2002", signed by authority of the Secretary of State and deposited at the Department for Transport, Local Government and the Regions, Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA;

"the Connecting Roads Scheme"

means "The M25 Motorway (Heathrow Terminal 5 Access) (No 1) Connecting Roads Scheme 2002";

"the Side Roads Order"

means "The M25 Motorway (Heathrow Terminal 5 Access) (No. 1) Side Roads Order 2002"; and

"the special roads"

means the special roads which the Secretary of State is authorised to provide pursuant to the Connecting Roads Scheme.

This Order shall come into force on 5th March 2002 and may be cited as the M25 Motorway (Heathrow Terminal 5 Access) Compulsory Purchase Order (OD No 27) 2002.

The M25 Motorway (Heathrow Terminal 5 Access) (No 1) Side Roads Order 2002

The Secretary of State for Transport, Local Government and the Regions makes this Order in exercise of powers conferred by sections 18 and 125 of the Highways Act 1980 and of all other powers enabling him in that behalf:-

1

  1. The Secretary of State is authorised in relation to the connecting roads to carry out the following works:-
    1. improvement of each highway named in a Schedule and shown on a plan by cross hatching;
    2. stopping up of each length of highway described in a Schedule and shown on a plan by zebra hatching;
    3. construction of a new highway along each route whose centre line is shown on a plan by an unbroken black line surrounded by stipple;
    4. stopping up of each length of private means of access to premises described in a Schedule and shown on a plan by a solid black band; and
    5. provision of a new means of access to premises along each route or at each location shown on a plan by thin diagonal hatching.
  2. Where a new highway is to be constructed wholly or partly along the same route as a new access or part of one, that new highway shall be created subject to the private rights over that new access.
  3. Each new highway is given a reference letter on a plan, which is also placed in a Schedule, and will be a road unless the word "bridleway" or "footpath" appears beneath its reference letter in that Schedule, in which case it will be a bridleway or footpath (as the case may be). Each new access is given a number on a plan, which is also placed in a Schedule.
  4. Where a new highway is to be constructed or a new access is to be provided in connection with the stopping up of a length of highway or private means of access described in a Schedule, its reference letter or number (as the case may be) is placed in that Schedule opposite the description of that length.
  5. Each plan shows the works indicated in a Schedule and has the same number as that Schedule, and the routes of the connecting roads are shown in relation to the works shown on each plan.

The Secretary of State is satisfied -

  1. as respects each length of highway the stopping up of which is authorised by this Order, that another reasonably convenient route is available or will be provided before that length is stopped up, and
  2. as respects each length of private means of access the stopping up of which is authorised by this Order, that other reasonably convenient means of access to the relevant premises are available or will be provided before that length is stopped up or that no access to the relevant premises is reasonably required.

Each new highway shall be transferred to the highway authority shown in the relevant Schedule opposite the reference letter of that new highway with effect from the date on which the Secretary of State notifies them that it has been completed and is open for traffic.

Where immediately before a length of highway is stopped up pursuant to this Order there is under, in, on, over, along or across that highway any apparatus of statutory undertakers or telecommunications code system operators then, subject to Section 21 of the Highways Act 1980, those undertakers or operators shall continue to have the same rights as respects that apparatus as they had immediately before the stopping up took place.

In this Order:

  1. all measurements of distance are approximate only, and are measured along the route of the relevant highway or private means of access to premises, as the case may be;
  2. a reference to a numbered article, Schedule or plan is a reference to the article of or the Schedule to this Order, or to the plan, so numbered; and "a Schedule" means a Schedule to this Order.
  3. (i) "the connecting roads" means the special roads which the Secretary of State is authorised to provide along the routes described in the Schedule to the Scheme;

    (ii) "improvement" in relation to a highway includes raising, lowering or otherwise altering the highway, and "improved" shall be construed accordingly;

    (iii) "new access" means a means of access to premises authorised by this Order to be provided;

    (iv) "new highway" means a highway authorised by this Order to be constructed;

    (v) "plan" means one of the site plans numbered 1 to 4, and contained in the plan folio numbered HA Plan No 18/1/RPD/1 marked "the M25 Motorway (Heathrow Terminal 5 Access) (No 1) Side Roads Order 2002", signed by authority of the Secretary of State and deposited at the Department for Transport, Local Government and the Regions, Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.

    (vi) "the Scheme" means the M25 Motorway (Heathrow Terminal 5 Access) (No 1) Connecting Roads Scheme 2002.

This Order shall come into force on 5th March 2002 and may be cited as the M25 Motorway (Heathrow Terminal 5 Access) (No 1) Side Roads Order 2002.

The Secretary of State for Transport, Local Government and the Regions makes this Scheme in exercise of powers conferred by sections 16, 17 and 19 of the Highways Act 1980(a) and now vested in him (b), and of all other powers enabling him in that behalf:-

(a) 1980c.66.

(b) SI 1981/238.

  1. This Scheme may be cited as the M25 Motorway (Heathrow Terminal 5 Access) (No 1) Connecting Roads Scheme 2002 and shall come into force on 5 March 2002.
  2. In this Scheme:
    1. "connecting roads" means the special roads described in Schedule to this Scheme;
    2. "the plan" means the plan numbered HA Plan No HA/16/OD/29, marked "The M25 Motorway (Heathrow Terminal 5 Access) (No 1) Connecting Roads Scheme 2002" signed by authority of the Secretary of State for Transport, Local Government and the Regions and deposited at DTLR Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonard's on Sea, Hastings, East Sussex TN37 7GA; and
    3. "the special roads" means each connecting road.
  3. The Secretary of State is authorised to provide the special roads for the exclusive use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980.
  4. The centreline of each of the special roads is indicated by a heavy black line on the plan.
  5. Each of the special roads shall become a trunk road on the date when this Scheme comes into force.
