THE HIGHWAYS ACT 1980
THE ACQUISITION OF LAND ACT 1981
THE M25 MOTORWAY (HEATHROW TERMINAL 5 ACCESS) COMPULSORY PURCHASE ORDER (OD No 27) 2002

NOTICE IS HEREBY GIVEN that the Secretary of State for Transport, Local Government and the Regions in exercise of his powers under sections 240, 246 and 260 of the Highways Act 1980, as extended and supplemented by section 250 of that Act and under section 2 of the Acquisition of Land Act 1981, and all other powers enabling him in that behalf on the 5th March 2002 made a Compulsory Purchase Order entitled as above, authorising him to purchase compulsorily:

  1. the land and rights described in the Schedule hereto for the purpose of:
    1. the construction of the special roads near Longford in the London Borough of Hillingdon at Staines; in the Borough of Spelthorne; and in the Parish of Colnbrook with Poyle, in the Borough of Slough in pursuance of the M25 Motorway (Heathrow Terminal 5 Access) (No.1) Connecting Roads Scheme 2002;
    2. the construction of highways and the provision of new means of access to premises near Longford, in the said Borough; at Staines, in the said Borough and County; and in the parish of Colnbrook with Poyle, in the said Borough and County in pursuance of the M25 Motorway (Heathrow Terminal 5 Access) ( No.1) Side Roads Order 2002 ;
    3. the improvement of the M25 Motorway near Longford in the London Borough of Hillingdon ;
    4. the diversion of watercourses and the execution of other works on watercourses in connection with the construction of special roads, the construction and improvement of other highways and the execution of other works mentioned above ;
    5. use by the Secretary of State in connection with the construction and improvement of highways and the execution of other works mentioned above and
    6. (vi) the mitigation of any adverse effect which the existence or use of the special roads and certain of the highways which the Secretary of State proposes to construct or improve will have on their surroundings thereof.

COPIES of the Compulsory Purchase Order and of the plan referred to therein, together with copies of the above mentioned Connecting Roads Scheme and Side Roads Order, all with their accompanying plans, have been deposited and may be seen at all reasonable hours from 5th March 2002 to 18th April 2002 at the Highways Agency, Q(IM), Room G/44, St Christopher House, Southwark Street, London, SE1 OTE and at the offices of the Highways Agency, Operations Directorate (Special Projects), Floor C8, Broadway, Broad Street, Birmingham B15 1BL; Government Office for the South East, Bridge House, 1 Walnut Tree Close, Guildford, Surrey, GU1 4GA; the London Borough of Hillingdon, Civic Centre, High Street, Uxbridge, UB8 1UW; the London Borough of Hounslow, Civic Centre, Lampton Road, Hounslow, Middlesex, TW3 4DN; Spelthorne Borough Council, Council Offices, Knowle Green, Staines, TW18 1XB; West Drayton Library, Station Road, West Drayton, UB7 7JS; Harlington Library/Harlington Community School, Pinkwell Lane, Hayes, UB3 1PD; Stanwell Library, Hadrian Way, Stanwell, Middlesex, TW19 7HE and at Heston Library, New Heston Road, Hounslow, Middlesex, TW5 0LW.

COPIES of the Order can be obtained from the Highways Agency, Operations Directorate, Floor C8, Broadway, Broad Street, Birmingham B15 1BL, quoting reference HA/67/22/98.

THE Order as made becomes operative on the date on which this notice is first published. Any person aggrieved by the Order who desires to question its validity, on the grounds that:

  1. the authorisation granted by the Order is not empowered to be granted; or
  2. their interests have been substantially prejudiced by failure to comply with any statutory requirement relating to the Order,

may apply to the High Court within 6 weeks from the date of first publication of this notice. On such an application the Court may suspend or quash the Order or any provision in it.
