Statutory Orders
Orders provide the legal basis for the Secretary of State’s proposals for the improvement Scheme. The Orders are for the line of the new road, the detrunking of the existing road, the roads to be improved, alterations to accesses and public rights of way and the land required for the construction of the Scheme.
Following the decision on Regional Funding and a confirmed Construction start date of 2012/13, we republished the draft Orders and the Environmental Statement on 26 January 2007. The objection period, in which you may submit responses to the draft Orders ends on 9 March 2007.
Please note that the ES and draft Orders published on 9 December 2005 have now been withdrawn. However, if you have already made comments of support or representation or if you have registered an objection to the proposals, you do not need to write in again to repeat your existing objection or representation.
The Pre-Inquiry Meeting and the Public Inquiry are now planned for May and July 2007 respectively. We will be issuing our revised Outline Statement of Case in due course and any objectors’ Statements of Case that we have already received will still stand and need not be resubmitted.
The Public Inquiry into the proposals will be held before an independent Inspector. We will notify those who have responded of the date and the venue at least six weeks beforehand. We will also publish notices in the local press.
After the Inquiry, the Secretary of State for Transport and the Secretary of State for Communities and Local Government will consider the Inspector's Report, together with any objections and representations made, before making their decision on the future of the project.
