Compensation Claims under Part I of the Land Compensation act 1973

Where properties have been affected by the use of the M6 Toll road, we will pay compensation for the depreciation in value to the property. 

The Highways Agency asked consultants to produce a detailed map that shows noise levels before and after the opening of the new motorway to help inform the negotiations.

The noise map is also not the only factor to be taken into account when the compensation is negotiated.

The map has been produced using a combination of measurements and predictions and has been provided to the Valuation Office Agency and claimants agents.

How have noise levels changed?

The map shows some noise levels are now lower than those measured before construction, thanks to the use of low noise surfacing and the overall design of the road.

We recognise that other homeowners may have experienced an increase in volume since the road opened, or a change in the direction of the noise. We are prepared to compensate accordingly.

Has settlement of claims been delayed?

There has not been a significant delay in the process of agreeing compensation caused by use of the map.

Law dictates that the process for making a claim begins one year after road opening, leaving a period for changes in local traffic flows and all the physical effects on properties to be effectively measured.

The speed at which claims are negotiated and settled is determined by the Valuation Office Agency and their discussion with homeowners or their agents.

Why has a noise map been used?

A noise map has been used for this project as a pilot to determine whether this type of information is useful. If it is, we may commission it for other projects in the future.

We have also recognised that there are a number of possible anomalies in the noise map. We are now addressing these to ensure valuers have the best available information to aid negotiations.

How do I know whether I can make a claim?

Any entitlement to claim compensation is detailed within the Land Compensation Act 1973 and is generally is dependent on having been a local homeowner before the new toll road opened and continuing to live in it on the day the claim was made.
